Terms & ConditionsIt is each individual traveler's responsibility to read and understand the terms and conditions of Travels In Wine, LLC prior to submitting a tour reservation. PARTIES: Travels In Wine, LLC, provides tours to the Napa Valley and other travel destinations. These Terms and Conditions apply to each Tour program provided by Travels In Wine, LLC. In these Terms and Conditions, the undersigned is hereinafter referred to as "Guest". RESERVATIONS are accepted by Travels In Wine, LLC upon receipt of a completed and signed, printed reservation form, or upon receipt of a completed and electronically signed, online reservation form accompanied by a non-refundable deposit of US$500 per Guest per Tour. The remaining balance of the Tour is due no later than 90 days prior to the Tour departure date, and invoices for final payment of Tour will be emailed to each Guest prior to the Tour final payment due date. Reservations made within 90 days of Tour departure date must be accompanied by full payment. If Travels In Wine, LLC does not receive final payment of Tour from Guest by 90 days prior to Tour departure date, Travels In Wine, LLC reserves the right to cancel Guest's reservation at which time Guest forfeits the non-refundable deposit. Travels In Wine, LLC reserves the right to assess a $350 per person late fee for final payments received after the final payment due date. Specialty event tours, private tours and custom designed tours require a non-refundable deposit of $1000 per person, and final tour payment for specialty event tours, private tours and custom designed tours is due no later than 120 days prior to the tour departure date. CLIENT CANCELLATION & REFUND POLICY: If Guest chooses to cancel his or her reservation, Travels In Wine, LLC must receive written notice of said cancellation in writing via certified mail, or e-mail sent to info@travelsinwinetours.com (with confirmation of receipt from Travels In Wine, LLC), and Guest shall be subject to the following cancellation fee schedule: If Travels In Wine, LLC receives written notice 91 or more days prior to the Tour start date, Travels In Wine, LLC shall with-hold the non-refundable deposit. If Travels In Wine, LLC receives written notice 31-90 days prior to the Tour start date, Travels In Wine, LLC shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 50% of the remaining balance due for the Tour. If Travels In Wine, LLC receives written notice 30 days or less prior to the Tour start date, Travels In Wine, LLC shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 100% of the remaining balance due for the Tour. If Travels In Wine, LLC receives no written cancellation from Guest and Guest does not show-up for the Tour per Guest reservation, Guest shall incur a cancellation/no-show fee equal to 100% of the Tour price. Cancellation date is the date such notice is received in writing by and acknowledged as received by Travels In Wine, LLC. Specialty event Tours, Private Tours and custom designed Tours cancellation fees are as follows: If Travels In Wine, LLC receives written notice 121 or more days prior to the Tour start date, Travels In Wine, LLC shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 25% of the remaining balance due for the Tour. If Travels In Wine, LLC receives written notice 61-120 days prior to the Tour start date, Travels In Wine, LLC shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 50% of the remaining balance due for the Tour. If Travels In Wine, LLC receives written notice 60 days or less prior to the Tour start date, Travels In Wine, LLC shall with-hold the non-refundable deposit and Guest shall incur a cancellation fee equal to 100% of the remaining balance due for the Tour. Should Guest cancel his/her reservation 91 days or more in advance of the departure date, Guest may elect to roll the entire $500 per person non-refundable deposit into a future trip credit to be used towards a Travels In Wine, LLC trip departing within 12 months of the original trip cancellation date. This credit can only be rolled over once. Travels In Wine, LLC CANCELLATION OR SUBSTITUTION: Travels In Wine, LLC may cancel any Tour at any time before departure for any reason, including without limitation, if Travels In Wine, LLC deems the number of Guests signed up for a given Tour to be insufficient to operate such Tour. Travels In Wine, LLC may in its' sole discretion substitute a Service or Good of similiar quality for any Service or Good stated in a Tour itinerary. Travels In Wine, LLC shall attempt to notify Guest of the cancellation of a Tour for which Guest has paid a deposit or Tour Fee as soon as possible after Travels In Wine's final decision to cancel such Tour. If a Tour is cancelled, Travels In Wine's liability is limited to a full refund of affected Guest's Tour deposits and Tour Fees, and Travels In Wine, LLC will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances. Travels in Wine, LLC is not responsible for any loss incurred on account of non-refundable or non-transferable air tickets. If for reasons beyond Travels In Wine's control, a Tour in progress must be interrupted or cancelled, Travels In Wine, LLC will in good faith refund a portion of the Tour Fees depending on Travels In Wine's actual costs incurred compared to the Tour as originally contemplated. INCLUDED: in the price of the Tour are the following: Professional Travels In Wine, LLC Tour leader who also serves as Guests' liaison during the Tour, hotel accommodations as designated by Travels In Wine, LLC during the Tour, entry fees to each event detailed in the finalized tour itinerary, fees for interactive excursions during the Tour as detailed in the finalized itinerary, such as, cooking classes, wine tasting workshops, cooking classes, some beverages during meals provided on the Tour as detailed in the finalized tour itinerary, hotel taxes, breakfast as detailed in the finalized tour intinerary, gratuities to service personnel at restaurants designated in the finalized itinerary and at the hotel, meals as specified in the finalized itinerary, private ground transportation during the tour from Tour start date pick-up and Tour conclusion drop-off. NOT INCLUDED: in the cost of the Tour are the following: Roundtrip airfare to and from Napa Valley, telephone calls, personal items, laundry, individual purchases, pre-dinner alcoholic beverages, wines beyond provisions of the tour, extra meals or snacks, room service, cocktails, or personally ordered wines, even if consumed in place of provisions provided during the Tour, gratuities to Tour Guide(s)/Leader(s)s of Guest's specified Tour, any other costs not specified in the finalized Tour itinerary or elsewhere in writing. Guest is responsible for all of the above and the cost of any changes he or she makes outside the Tour and Tour provisions. Guest is responsible for transportation costs to and from the Tour hotel in the event that Guest is unable to participate in the group pick-up on tour start day and/or group drop-off on tour conclusion day. PRICES: Travels In Wine, LLC ONLY guarantees a Tour price as indicated on our website upon Travels In Wine's receipt of Guest's completed online Tour booking form. Otherwise, prices are subject to change without notice. Once Travels in Wine, LLC receives Guest's completed Tour booking form, Guest's Tour price is guaranteed and the Tour price will NOT increase. ACCOMMODATIONS: Guest accommodations during a Tour are double or twin occupancy (single supplement is allowed upon request for an additional fee), and will include private, fully equipped bathrooms. Hotels are selected for their charm, comfort and luxury. Hotel rooms are well appointed, individual, private rooms with large comfortable queen or king size beds and fully equipped, private bathrooms that Travels In Wine, LLC has determined to meet its' strict criteria. RESPONSIBILITY: Travels In Wine, LLC expressly limits its' performance to the delivery of a Tour with accompanying food, lodging and ground transportation from site to site. Travels In Wine, LLC and its' agents will not be responsible for any direct or indirect consequential damages or injury that may result from a Tour. The Guest is completely responsible for all actions, and agrees to hold harmless Travels In WIne, LLC and its' agents for any accident, damages or injury. Travels In Wine, LLC and its' agents are not responsible for Acts of God or acts of war/terrorism, and Guest agrees to hold Travels In Wine, LLC and its' agents harmless for any incident or injury resulting from the same. Only Travels In Wine, LLC may finalize an order or Tour booking and make it a binding contract to provide the services of Travels In Wine, LLC to Guest. Responsibilities of Guest include, but are not limited to the adherence of all local laws, assessing abilities, respecting other Guests' privacy, and following the suggestions and advice of Travels In Wine, LLC during a Tour. Travels In Wine, LLC reserves the right to decline, accept, or retain at any time, any Guest, as a participant of a Tour, if Travels In Wine, LLC deems that Guest behavior is disruptive to the group or Tour, is inappropriate and offensive to the Group or interferes with the delivery of services of the Tour. Travels in Wine, LLC reserves the right to remove any Guest from a Tour should Travels In Wine, LLC determine that the Guest cannot meet the physical requirements of the Tour, as stated in the Tour itinerary, or is disruptive to the Tour time schedule, or is adversely affecting the overall group dynamics. In the event that a Guest is removed from a Tour, Travels In Wine, LLC will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. In the event that a Guest voluntarily chooses to leave a Tour, Travels In Wine, LLC will require a written, signed statement of the Guest's intent to depart from the Tour. In the event that a Guest voluntarily departs from a Tour, Travels In Wine, LLC will not refund any monies to the Guest. Transportation costs to return home, airline penalties, and any other expenses will be the responsibility of the Guest. During a Tour, Guest participates in as many or as few activities of interest to him or her. No refunds for unused services, activities, excursions, workshops or portions of a Tour for any reason will be made to Guest. INSURANCE: Trip cancellation/interruption insurance is recommended, but not required to participate in a Tour. Trip cancellation/interruption insurance will protect Guest should he or she need to cancel for certain necessary reasons such as illness, unemployment, death, and provides Guest refunds for air and Tour in full. Additional insurance for baggage, health/accident is also strongly recommended and available through most major travel insurance providers. View our Links page to vist a few recommendations.
